Subject: Update and Councilmember Graham's report

I spoke with Frances Smith, executive director of the the Financial
Authority, this morning and indicated that the 12 month period for the
transfer of the property rights was not tenable. He said that he said that
he had received a call from Bob Walker of the Redevelopment Land Agency, and
that Bob had expressed the same sentiment. Frenchie said that the the Board
put the 12 month provision in because they don't like the ERA process and
they are tired of the process taking so long. He said that the history of
previous ERA's is that they don't result in a timely development of the land.
I said that Tivoli Partners should not be penalized because of the Board's
displeasure with previous ERA's. He agreed and said that he told Bob that we
needed to provide the Board with a detailed explanation of why we need more
time and that they will take it under consideration.

Subject: [columbia_heights] Control Board Approval of Tivoli Dear Friends: The Control Board has approved the Exclusive Right Agreement
for both parcel 27 and 29 in Columbia Heights. I have yet to see the ERA,
however I am informed by the Control Board that it is about the same document
as the one approved by the Redevelopment Land Agency. The final document
will be available (again I am told) within 30 days.
There is one significant change. The Control Board has required that the
process leading to the Land Development Agreement (which is the final
document in the development process) must occur within 12 months of the final
issuance of the ERA. That means this process must be over by about June
2001. The Control Board insisted on this deadline so as to move the process
as rapidly as possible through the bureaucracy.
Again, I have not seen the document. It is unclear whether it contains the
Mayor's direction that the developers for the Tivoli parcel reconfigure the
design to avoid breaking through the rear wall of the Tivoli.
By the way, tentative plans are ready on that score. It is not known as yet
what they propose. So its possible the 90 days for that process may not be
necessary.
Of course, it all depends on what those plans propose.
Also, the $2 million for the restoration and preservation of the Tivoli
remains in the capital budget which will be the subject of Council action
this coming Friday.
